Abstract

The Mexican constitutional order provided a new dimension to the alternative dispute resolution mechanisms, in various areas, with the purpose of reducing the workload of the courts, as well as addressing administrative disputes to reduce the budgetary impact. The main objective of the “MASC” lies in the reduction of litigation between the parties through the use of two legal institutions: conciliation and arbitration, which make it possible to adopt more friendly positions and bring them closer in their claims in order to resolve their differences. Thus, the State fulfills one of its fundamental roles: to reduce social tensions.
